1. Introduction and Platform Terms

This document is an electronic record under the Information Technology Act, 2000. By accessing https://ochrespirits.com you agree to be bound by these Terms of Use.

  • Eligibility: You must be of legal drinking age in your current state/jurisdiction to access this site or purchase our products. We reserve the right to terminate access if it is discovered that a user is underage.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your account and password. Ochre Spirits is not liable for any unauthorized access resulting from your failure to secure your credentials.

2. User Conduct

You agree not to host, display, or share any information on our Platform that:

  • Belongs to another person without authorization.
  • Is defamatory, obscene, or encourages illegal activities (e.g., underage drinking or bootlegging).
  • Infringes on the intellectual property of Ochre Spirits.

3. Alcohol Sales & Compliance

  • Verification: All orders are subject to mandatory age verification. We may request a government-issued photo ID at the time of delivery or entry to our physical premises.
  • Compliance with Local Laws: Ochre Spirits operates in strict accordance with the Indian Excise Act and other state-specific regulations. Availability of products and delivery options may vary based on local state laws and dry day schedules.
  • Quantity Limits: To promote responsible drinking and comply with excise laws, we reserve the right to limit the quantity of spirits purchased per transaction.

4. Hospitality & Reservations (Ochre Bar & Kitchen)

  • Reservations: Booking a table via our Platform does not guarantee immediate entry if the venue is at capacity or if the guest fails to meet the age or dress code requirements.
  • Cancellations: We reserve the right to charge a cancellation fee for "no-shows" on high-demand nights or special tasting events.

5. Intellectual Property

All content on the Platform, including but not limited to the "Ochre" logo, spirit bottle designs, website layout, and marketing copy is the exclusive property of Ochre Spirits Private Limited. Any unauthorized use, reproduction, or modification for commercial purposes is strictly prohibited.

6. Limitation of Liability

  • Indirect Damages: Ochre Spirits shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or services.
  • Product Quality: While we maintain the highest standards of craft distillation, any claims regarding product defects must be reported within 24 hours of purchase or delivery.
  • Maximum Liability: Our total liability for any claim shall be limited to the amount paid for the specific product or service in question.

7. Returns and Cancellations

  • Alcohol Products: Due to excise regulations and the nature of the product, returns on spirits are generally not permitted once the seal is broken or the product has left the premises/delivery vehicle, except in cases of manufacturing defects (e.g., broken seal upon arrival).
  • Merchandise: Returns for non-alcoholic merchandise (e.g., glassware, apparel) are subject to a 7-day return window, provided items are in original condition.

8. Termination

We reserve the right to suspend or terminate your access to the Platform without prior notice if we believe you have violated these Terms, especially regarding age misrepresentation or fraudulent activity.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in Karnataka, India.
